Are you eligible for overtime – know before you file a case

Are you working overtime for the last few months and not paid for it? If yes, it is high time to consult a lawyer. US Fair Labor Standards Act (FLSA) provides employees the right to claim overtime, i.e. extra wages at the rate of one and half times of the regular rate, if they work for more than 40 hours in a single workweek.

Like all states, Ohio adheres to this federal ruling. The question is what you do if you are in the same situation. You can either file a complaint at the US Department of Labor or file a lawsuit. The last option is chosen more often, as it helps you obtain back pay, court costs and lawyers’ fees as well.

Do you know whether you are exempt or non-exempt? This determines whether you are under FLSA coverage or not. Exempt employees do not have this coverage. Certain professionals like police officers, doctors, etc belong to this category. Your status, exempt or non-exempt, also depends on your pay package.
